I think ANets stance on most 3rd party stuff is "Use at your own risk". You can be pretty sure that if your GW gets screwed or your account gets high-jacked, you won't get much help from them.

Anets stance on Texmod is you can use it, and you won't get banned. However, if you have a problem connected to Texmod, they cannot and will not help you.

It's been asked many times before, and the answer has always been the same: not illegal, just that Anet won't help you if you get hacked or it screws over your computer/version of Guild Wars you have installed.

As long as it's not something like an automated program, I think A-net could care less. I mean, if you're botting and whatnot to farm gold, that's cheap and unfair. But if you're altering the textures and the like, it's fair game.

However, Anet has officially given their stance that Texmod is OK. Texmod doesn't actually alter the program, it alters the textures used in memory. From a pure technical standpoint that is still "altering the Guild Wars program", but they have said they do not see it that way.
I suppose you should pretty much use your own judgment here also - if someone finds some real hack that is possible through texmod it *will* get the ban hammer to use it. But as of right now there are none known to the community at large and for the most part there *shouldn't* be any hack using texmod that isn't instantly obvious that it will result in the ban hammer (I mean, if you can use it for a buffer overrun attack then it is obvious to not use it).
