Ok so my girlfriend forgot i had guild wars, and she bought the faction platinum edition..which comes with prophecies + game of the year bonus included. now im stuck with in since she already payd for it..well im telling myself if its legal for me to sell it for ingame gold.

It isn't. It's never legal to sell anything that isn't in game for something that is in game.

Take it back and exchange it for a copy of Factions, Nightfall, or GWEN if it hasnt been opened. Selling your account for any currency, whether in-game gold or real-life money, is against the terms of EULA and can get you permanently banned.

How is selling outside the game for outside money illegal? You never agreed to anything if you haven't installed the other copy of the game, and didn't agree to any contract, and even if it were illegal, they would'nt be able to ban you for selling it cuz they wouldn't know who you are.

Generally people who resale "new" accounts are scammers. It not illegal to do that, if you've never used it, but most people try to sell accounts as new when they're not.
You'd be stupid to buy GW on eBay or some place like that for that reason.

As long as the key is still sealed, you may be able to return it. If not, you could probably sell it somewhere else but not for in game gold. That will get you all kinds of banned.

Just have your girlfriend start playing Guild Wars with you, with that account. :P
