Are we playing on an outdated EULA?

I have seen posts on guru about getting banned for fame farming and I am concerned about the way Anet treat people. It seems to me that they do not follow the EULA 5% of the time or is it because they are unaware of the outdated list we, the players have agreed upon before we can play guild wars.

Some people get banned for doing things, others don't. I believe that ANet has update their EULA recently on a number of points, so I wouldn't be surprised if certain people passed over those parts, didn't care, or missed the memo.
I'd say it's more a case of people getting banned for different reasons because their take on the EULA was not the same as ANet's.

This sort of thing should be in the rules of conduct rather than the EULA anyhow, so we don't have to wade through all the legal stuff to know what will get us banned.

Fame farming is when someone pays another guy (someone who is good at HA) to farm fame. You pay per fame.
Generally this involves gimmicks that are easy to run.

From what I know undermining sport and competition spirit of the game was always a bannable offense. On their place I would first ban 50k accounts for notorious rolling over hero battles and then forward a solution to stop it. Fame farming the same ... I guess it will hurt losing your shitty tiger or phoenix and will make you think twice before this ... of course 'fame buyer' would get his share of the ban too. Tbh, they should have been banning for this since beginning, the only flaw you can point out in this. I guess some of people thought they are untouchable with this silly business. Well, their problem.

If you actually read the thread about fame farming, you'll see that Regina herself posted and explained he wasn't banned for fame farming, but for another violation entirely.
Furthermore, the umbrella clauses in the EULA where they say things along the lines of "we can cancel your account at any reason for any time" can be used to include anything. Violations don't have to be specifically listed. A.net has discretion. Heck, they could ban every 5th account "just because" and it would be perfectly legal.

There are no confirmed bans for fame farming, because it doesn't break any rules. If there WERE people seemingly banned for it, it's likely that they were banned for other offenses (such as ebaying the gold to pay for fame). There aren't any rules against fame farming...because there's no need. It's not like they abuse glitches, or hack the game, they just take a bad player along in their gimmick, who generously pays for the opportunity to join them.

It would be ridiculous to ban people for that, now that i know what it is. It's like saying, "Oh we see you've been playing the game and fame farming but without cheating, hacking or using glitches, banned anyway for the lulz"

EULAs and/or your "right" not to be randomly banned are still a contested legal area. Basically whoever funds the better lawyers is right. Anet will ban for any excuse they want to invent, and at best you could maybe sue them for it, but most users won't.

Actually even if you read it, you need an incredible amount of common sense to understand that you gonna get banned because you char name is an dirty word in the 3rd patois of the last of mohicans
