Is it Against the EULA...

...to sell your Guild Wars account on Ebay? I don't want to sell items or anything like that, but I'm thinking about selling the whole sha-bang. I just don't want to do so if it's against the rules...until recently, A.Net has done nothing but right by me and given my many many hours of fun (more than worth the price of 2 games) and I've had a blast up 'till now so I don't want to screw them over or anything.

Assuming it's ok to sell it, the next question would be how much is it worth but maybe I should take screenshots of what I have and head over to Price Check to find that out

It's against the EULA to sell your account anywhere. A quick search of the EULA for popped up with this:

"3. LICENSE TO USE:

You may not (a) sublicense, rent, lease, loan or otherwise transfer the Software or the Service (or any part thereof), including without limitation access keys [etc etc blah blah blah...]"

I'm sure there's more in there about how NCsoft will ban your account if you do that kinda thing, but you probably knew that already.

you know this has been an issue for a very very long time about what you can and what you cannot do lol. so for those of you that want to get rid of your stuff here we go! 1-ebay will no longer let you sell your account they remove it within days of putting it up. 2-why is this against the eula i paid for the game i farmed the items i have and i alone got all my 15k armors. seems to me like i own the game i bought. now yes i dont own the distrabution of the services to me but if the person you sold the account to breaks the rules well then to bad for them.

That's fine. I can just stop playing once I'm done. It was well worth the $100 I spent on it (well, Prophecies was worth $100 easy....Factions was worth about $30 ).

I knew you couldn't sell items & gold but I wasn't sure if the whole thing was the same.

As for the whole time = property argument, I expect to see some interesting lawsuits in the future based on the EULAs of online games. The fact that you either agree to them or lose $50 is going to come into question once someone who has funding, free time, and no life decides to fight it. Fact is, the EULA could say anything they want it to and, since you can only see it once you have made the game unreturnable, you have to click 'yes' or just lose your money.

Regardless, I will refrain from selling my account on eBay (*laugh* even though a simple search for "Guild Wars" on the site brings up thousands of auctions for gold and other items) and just put the game away when I am done.

The only way this can be done is if you ask Arenanet to delete your account or accounts so no one is getting what you did in game. There are several other titles on e-bay or even Amazon you might want to sell it there. Then agian there is always eb-games that will do it for consignment agian you will need to delete your account with Anet.

Anyway...

Yes, the whole concept of virtual property and intellectual copyright is a very sticky one. It's also a very new issue without much, if any, legal precedence.

The trouble is that by clicking on the EULA you agree that you have no rights at all in the matter. There are in many cases rights that you can not sign away regardless of the wording of any agreement.

For example: even if you sign a disclaimer to go bungee jumping, if you are injured do to the owner/operator's negligence the owner/operator are STILL liable.

The trouble is there are no rulings establishing what sort of rights players have to the online material they have created (characters, gold, etc...).

--

Just because something is against the EULA does not mean that ANet (or any other company with the EULA) is necessarily against that activity, nor does it mean those accounts will be banned. Much of what is covered in a EULA is there simply to cover all their bases legal liability wise and to save their customer support a heck of a lot of woes.

Crazy stuff...

To get around it, on the bottom of the ebay page put
(I am not selling my account, I am selling the time and hard work it took to level my account and aquire various items.)

I don't sell stuff on ebay because it is pathetic. People having to buy pre-leveled accounts, or rare items are in my opinion, the worst of the worst. I have, however, seen ebay pages, and seen that this is how they get around it.

If anet catches the person who is buying it, the sold account could end up being banned.

If the EULA is legal.. can be debated, but if it does end up being banned (legal or not) the person would have to take NCSoft/Anet to court over the matter.

Although this quote has little bearing on this subject, I'd counter with:

What is pathetic is a person that spends their life sucked deep into a game so they can have all the bells and whistles and feel oh so special about being "on top of" or "winning" a game where neither of those is possible.

Neither my statement nor yours is very open minded.

--

Some people have more time than money.

Others have money but no time.

Neither group is better than the other. They just have different circumstances. Why should either group be excluded from enjoying a game?

--

Now if you're implying that people that buy accounts, items, or gold are lesser players...

Skill does not equate to time spent.

Skill does equate to a persons learning curve and innate abilities.

I've met people that have played various games for months and years that never managed to grasp finer points or detailed tactics. Conversely, I've met people that have played for only a few weeks that can run with the best of them.

--

Blanket statements are rarely true and nearly always poorly though out or founded only in opinion.

Have a nice day.

Been there dozens of times without downloading unwanted crap. Granted, I haven't been to the site in the last few months though. I can't investigate it from here but I will look at it when I get home.

it is expressly against the end user license agreement and terms of use set forth by arenanet and ncsoft.
