In which case I'm going to assume it only triggers when your energy bar itself is completely gone. Even when you're at 0, there may still be some of the blue bar left. In which case, Wither and Malaise probably only end when that bar is completely empty.
I would consider reporting it as a bug.

The description requires your energy to be at 0 or less.
In which case, you would need to have say 12 energy, weapon switch to have -3 energy thus ending the hexes.
